The Country’s Supreme Court has denied IEBC chairman Wafula Chebukati, powers to amend or correct electoral results on Form 34 B after they are transmitted from polling station.

All five of the judges who heard Wafula Chebukati’s application for clarity ruled that his role in the October 26 fresh presidential poll will be limited to aggregating the 291 results as captured on the constituency result forms 34B but not making amendments.

The court however stated that the IEBC Chair should instead bring to light, any cases of discrepancies in the forms.

While reading out the decision, Deputy CJ Philomena Mwilu said they did not exempt the Chairman from verifying that the results on the forms 34B tally with those from the 40,883 polling stations from which they are computed.

The judges emphasised that the results to be relied on in the declaration of a winner, are those from the 291 constituencies.
