Acting Interior CS Fred Matiang’i is in new confrontation with courts over his failure to institute replacement of NGOs coordination board boss Fazul Mahamed.

The high court temporarily barred CS Matiang’i from renewing Fazul’s tenure after activist Okiya Omtata filed a petition protesting the continued stay of Fazul at the helm of the NGOs board even after his tenure expired last month.

“As a concerned citizen, I’m aggrieved that in defiance of the law, Fazul continues to be in office as the executive director of the NGO Coordination Board,” Omtata protested.

Judge Hellen Wasilwa of the Employment and Labour Relations court on Wednesday certified Omtata’s case as urgent.

Omtata told argues that Fazul’s term as the executive director of the board expired on November 23.

Since CS Matiang’i has not commenced the process of recruiting a replacement, the activist is afraid that an illegality was in the offing.

He wants the court to intervene.

Omtatah faults the CS for failing to commence the process of competitively reappointing or replacing Fazul by July 24.
